Welcome to the Pella ProLine Casement Window Settlement Website
The Court approved the settlement on March 15, 2019. There is now, pursuant to the Federal Rules, a period of time during which certain legal issues may be raised and resolved. The settlement will not become effective until that time period has expired.
Eubank, et al. v. Pella Corporation, et al. Settlement Update
The Claim Deadline for the Eubank settlement was June 20, 2018, which marks the end of the Claims Period. After the Claims Period ended, the settlement transitioned into the Extended Claims Period. The Extended Claims Period begins June 21, 2018.
What is the difference between the Claims Period and the Extended Claims Period?
The Claims Period was for any Eligible Damage to a Pella ProLine casement, awning, or transom window manufactured between January 1, 1991 and December 31, 2009 (“Pella ProLine Casement Window”) that manifested before or during the Claims Period. This would be Eligible Damage manifesting up until June 20, 2018. Claims during the Claims Period were to be made to the Notice and Settlement Administrator by sending a Claim Form the Notice and Settlement Administrator postmarked no later than June 20, 2018, and questions regarding a Settlement Claim made during the Claims Period should be directed to the Notice and Settlement Administrator, KCC, at 1-866-658-6764.
The Extended Claims Period is for any Eligible Damage to a Pella ProLine Casement Window that manifests starting June 21, 2018, through the time period during which any PSEP benefits are available for that particular window. Claims during the Extended Claims Period are made directly by contacting Pella’s Customer Service Department at 888-977-6387.
PLEASE NOTE: Extended Claims Period claims may be made for homes or structures for which claims were submitted during the Claims Period (through June 20, 2018), but such claims do not include Windows that were already the subject of a claim during the Claims Period.
